Services Terms and Conditions

VHS2DIG is a subsidiary of Modern Market Design LLC.

Unlawful Order Submissions and/or Materials

By submitting an Order, you represent and warrant the following to VHS2Digital: (a) no Materials submitted to VHS2Digital are submitted in violation of any copyright laws; (b) any Materials submitted were either created by you, you have the right to permit VHS2Digital to perform duplication services, or you have the permission of the copyright owner to duplicate the submitted Materials; and (c) no Materials submitted are libelous, obscene, offensive, threatening, defamatory, abusive, hateful, or otherwise violate state or federal law or the rights of a third party.

Returning original materials

Your materials will be returned upon payment of services. There are two methods to collect and return your original media. Your collection method should be specified in your order request form. (a) When selecting the drop off option, pick up of your media is also required within 14 days of completed service. We are not responsible for any material left with us after 14 days post completion of our work. (b)When requesting pickup of your media, drop off is also included when payment of service has been made. Normally your original media will be returned to you within 14 days of completed service. We will do or best to return your media sooner providing both parties are able to schedule arrangements for drop off.

Payment

Payment is due upon the completion of work and issuance of an invoice. Payment methods can be done by check payable to Modern Market Design LLC. sent to the address indicated on your invoice or by cash in hand upon return of your original media.

Handling

The safety and security of your original media is our top priority. For this reason, we do not use third party shipping carriers to obtain or return your original media. That said, the media types VHS2Digital are working with are often dated and at risk of becoming damaged in the digitization process. VHS2Digital takes several steps to reduce that risk and return your media in the same way we have received. In the rare case that your original media does become damaged in the process, VHS2Digital will refund you for our conversion service exclusively for tape or tapes that have been affected. No additional compensation will be made. VHS2Digital nor Modern Market Design LLC. is responsible for the loss or corruption of any data, original media, information, or other harm that results from your access to or use of our service. Your access to and use of the VHS2Digital service is at your own risk.

Refund

All sales are final. Once you place your order there are no refunds offered on any product or service except in the case where we advertise otherwise. We guarantee our products and services. If you are unsatisfied with our work for any reason, please let us know as soon as possible and a dedicated support agent will discuss options with you.

Limited Warranty

We make no warranty or guarantee with respect to the quality of the deliverables. You acknowledge that because of the quality loss that often occurs during the digitization process, the quality of the deliverables may not be as good as the materials you provide to us. Notwithstanding the foregoing, if you have any concerns regarding the deliverables that do not relate to quality loss and you communicate your concerns to us within thirty (30) days of receiving the deliverables, we will use commercially reasonable efforts to resolve the matter. If we are unable to resolve the matter, your sole and exclusive remedy will be a refund of the specific VHS2Digital service in question.

Terms of Agreement

The terms of this agreement will begin upon the date of your project request and will remain in full force and effect until the competition of the services.
